1. These Directions are enacted to accept and process relevant applications for the operation of remote-controlled unmanned aircraft for filming within the area of Shei-Pa National Park (hereinafter referred to as the Park), and in accordance with Item 5 of the Prohibited Activities in the Area of Shei-Pa National Park authorized under Article 13, Subparagraph 8 of the National Park Law, which prohibits operating remote-controlled unmanned aircraft without approval.

2.Any natural person, juristic person, school, or government agency (institution) wishing to use remote-controlled unmanned aircraft for filming within the Park shall submit an application to the Shei-Pa National Park Headquarters, National Park Service, Ministry of the Interior (hereinafter referred to as the Headquarters) 5 days prior to the filming date (calculated based on working days).

3.The control of remote-controlled unmanned aircraft activities by the Headquarters shall be handled in accordance with the remote-controlled unmanned aircraft activity areas announced by the special municipality or county (city) governments where the Park is located, as well as their relevant self-governing ordinances, the Civil Aviation Act, and other relevant regulations.

4.In accordance with the Civil Aviation Act, the remote-controlled unmanned aircraft applied for filming must obtain a registration number assigned by the Civil Aeronautics Administration (CAA) and have it clearly marked on a prominent part of the aircraft body before aerial photography activities can be conducted within the Park.

5. A natural person operating a remote-controlled unmanned aircraft with a maximum takeoff weight of 2 kilograms or more but less than 15 kilograms equipped with navigation devices, or a remote-controlled unmanned aircraft with a maximum takeoff weight of 15 kilograms or more, shall hold an operator certificate issued by the CAA before operating it; a remote-controlled unmanned aircraft used by a government agency (institution), school, or juristic person shall be operated only by a person holding an operator certificate issued by the CAA.

6.Applicants shall apply for aerial photography online at the Headquarters' official website, specifying basic applicant information, the theme and content description of the filming project, the model and quantity of filming equipment, the names of filming personnel or remote-controlled unmanned aircraft operators, filming locations (please list), and start/end dates of filming (the maximum period per application is 2 months; for commissioned filming cases, research and monitoring cases, etc., that require an extended filming period, please attach relevant supporting documents); if notified by the Headquarters to make corrections, the applicant shall make corrections within 7 days from the date of notification. Those who fail to make corrections by the deadline shall be deemed not to have applied.

7.If the applied filming location or scope is located within an Ecological Protection Area of the Park, a Park Entry Permit must be obtained.

8.To protect the natural resources and ecological environment of the Park, the Headquarters may restrict applications for remote-controlled unmanned aircraft activities when necessary; furthermore, during the Cherry Blossom Festival, musical performances, and exhibition activities at Wuling Farm, applications for remote-controlled unmanned aircraft activities may be restricted to protect visitor safety due to the large and relatively concentrated number of visitors.

9.The Leshan Base in the Guanwu Area of the Park is a restricted flight area within a radius of 5 kilometers (including the Guanwu Salamander Ecological Center, Guanwu Villa, Guanwu Waterfall, and the entrance of the East Branch of Dalu Forest Road, which are all located within this restricted flight area). Pursuant to the Civil Aviation Act and relevant laws and regulations, remote-controlled unmanned aircraft aerial photography activities are strictly prohibited (see Attachment 1 for the map of the restricted flight area).

10.To maintain the ecological and environmental landscape resources of the Park, aerial photography using remote-controlled unmanned aircraft within the Park shall comply with the Civil Aviation Act, National Park Law, Prohibited Activities in the Area of Shei-Pa National Park, and other relevant laws and regulations. Attention shall be paid to flight altitude, speed, volume, and wind speed, and racing or activities endangering ecology and visitor safety are prohibited. If the filming location is located in the Qijiawan Creek Basin, please abide by the provisions of the Wetland Conservation Act. In the event of visitor injury or damage to facilities caused by the operation of remote-controlled unmanned aircraft, the operator of the remote-controlled unmanned aircraft shall bear the relevant responsibilities.

11.Upon completion of filming, please immediately restore the site to its original state, and remove and carry all props and garbage out of the Park.

 

12.In case of any violation of the above provisions, the Headquarters will no longer accept applications from the violator within 2 years; for any damage caused to facilities, environmental landscape, or natural resources, besides bearing civil liability for damages, the Headquarters will also investigate and process the matter in accordance with the law.

13.If the filming location is not within the scope of the Park under the jurisdiction of the Headquarters, please contact the competent authority separately.

14.After receiving the approval document from the Headquarters, applicants shall carry the approval document, identity documents, and other supporting documents during filming for inspection.

15.If roads, scenic spots, and trails in the Park are closed due to heavy rain, earthquakes, snow season, or other temporary control announcements, please check the latest opening status of roads and trails on the official website of the Headquarters before entering the Park; if an approved application site is closed for any reason at the time of filming, the approval document for that closure period shall be deemed void; if an approved location is subject to a control announcement, please abide by the control items and cooperate with the instructions of site personnel. This approval document shall not be used for access control purposes.

16.If media organizations require aerial photography for unpredictable and real-time news needs, or if government agencies within the Park (including their contracted vendors) require immediate disaster repair, emergency relief, and operational management, they shall not be restricted by Point 2 of these Directions; if the aerial photography needs do not belong to the aforementioned categories, Point 2 shall still apply.

17.In the event of a violation of the above matters or relevant provisions of the Civil Aviation Act, violators shall be penalized according to the penalty provisions of the Civil Aviation Act, National Park Law, and other relevant regulations.
